If you do not agree with this Disclaimer, you must discontinue use of all BetterLytix Services immediately.

All content, data, analytics, reports, visualizations, summaries, educational material, and any other information (“Content”) provided by BetterLytix is intended strictly for informational and educational purposes.

BetterLytix:

4. Limitation of Liability

To the fullest extent permitted by applicable law, BetterLytix Tech LLC, its owners, shareholders, directors, employees, contractors, and affiliates shall not be liable for any:

• direct, indirect, incidental, consequential, special, or punitive damages,
• loss of profits, revenue, economic opportunities, business, or data,
• reputational, emotional, or psychological harm,
• damages arising from your use of, or inability to use, the Platform or Services,
• decisions or actions you take based on Content, analytics, or education provided by BetterLytix,
• issues caused by third-party platforms, tools, or integrations (e.g., Telegram, payment providers, hosting services),
• unauthorized access to your Account due to your negligence or third-party interference.

In any case where liability cannot legally be fully excluded, the total aggregate liability of BetterLytix Tech LLC shall not exceed the total Membership Fees paid by you to BetterLytix in the twelve (12) months immediately preceding the claim.

5. User Responsibility

You are solely responsible for:

• evaluating the suitability and relevance of BetterLytix Content for your own situation,
• complying with all local, national, and international laws applicable to your use of data and educational material,
• ensuring that accessing and using the Platform is lawful in your jurisdiction,
• verifying that you meet all legal age and competence requirements in your country,
• protecting your login credentials and access devices.

You agree not to:

• treat BetterLytix Content as financial advice, trading advice, or betting instructions,
• present BetterLytix Content to others as guaranteed, certified, or “fail-safe”,
• use the Services to support any illegal, unlicensed, or regulated activity in your jurisdiction.

BetterLytix assumes no liability for any misuse of its Content or Services by Users.

6. Service Availability

While BetterLytix strives to maintain stable, high-quality service, we do not guarantee continuous, uninterrupted, or error-free operation of the Platform.

Access may be suspended, limited, or interrupted due to (including but not limited to):

• maintenance and upgrades,
• technical failures, outages, or connectivity issues,
• cyberattacks or security incidents,
• force majeure events,
• regulatory or legal constraints.

Such interruptions do not entitle you to refunds, damages, or compensation of any kind.

7. Data and Security

You are responsible for safeguarding your login credentials, devices, and means of access to the Platform.

BetterLytix:

• uses reasonable technical and organizational security measures to protect systems and stored data,
• cannot guarantee absolute security of data transmission or storage,
• is not liable for breaches, interceptions, or unauthorized access resulting from factors beyond its reasonable control or from your own negligence (e.g., sharing accounts, insecure devices, using exposed networks).

8. No Client–Advisor Relationship

Use of the Platform and Content does not create any form of:

• financial advisory relationship,
• legal, tax, or business consultancy relationship,
• fiduciary duty,
• partnership or joint venture.

BetterLytix does not act as your advisor in any professional capacity. You must seek independent professional advice where necessary.

9. Governing Law and Jurisdiction

This Disclaimer shall be governed by and construed in accordance with the laws of Nevis.

Any dispute arising out of or in connection with this Disclaimer shall be subject to the exclusive jurisdiction of the competent courts in Nevis, unless mandatory law in your country of residence provides otherwise.

10. Severability

If any provision of this Disclaimer is found to be invalid, unlawful, or unenforceable, such provision shall be interpreted, limited, or severed to the minimum extent necessary to make it enforceable. The remaining provisions shall continue in full force and effect.

11. Acknowledgement

By accessing or using any BetterLytix Platform, Content, or Service, you confirm that you:

• acknowledge that BetterLytix is not responsible for your actions, decisions, or resulting outcomes,

5. accept that updates or additions to any legal document apply automatically to your continued use of the platform,
6. agree that hyperlinks to such documents constitute valid and enforceable legal notice,
7. understand that using the platform requires full acceptance of ALL current and future linked policies without exception,
8. accept that any breach of any individual document may result in suspension, restriction, or termination of access,
9. agree that the governing law for all documents is St. Kitts & Nevis,
