1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your (“User”) access to and use of services provided by BetterLytix Tech LLC (“BetterLytix,” “we,” “our,” “us”).
By purchasing, subscribing to, or accessing any BetterLytix service, you confirm that you have read, understood, and accepted these Terms.

These Terms operate alongside our:

• Affiliate Agreement (if applicable)

In case of conflict, the English version of all documents prevails.

2. Definitions

2.1 Platform – All official BetterLytix websites, dashboards, channels, or digital environments operated by BetterLytix Tech LLC.

2.2 Account – Your personal login or access credentials to BetterLytix services.

2.3 Services – Access to digital analytics (Insight Engine), educational content (Academy), and related tools.

2.4 Membership Fee – The paid fee granting access to BetterLytix services.

2.5 Affiliate Program – Independent referral and commission structure governed by the Affiliate Agreement.

2.6 Data Content – Information, structured data, insights, summaries, or analytics provided through BetterLytix Insight Engine.

3. Nature of Services

BetterLytix Tech LLC operates exclusively as a data analytics and educational technology company.

We provide:

• structured data insights,
• informational analytics,
• learning content in entrepreneurship and emerging technologies.

BetterLytix Tech LLC does NOT:

• provide betting services or gambling facilitation,
• offer financial advice, investment recommendations, or forecasts,
• manage user funds or provide wallet services,
• guarantee outcomes, decisions, or results.

All content is for informational and educational purposes only.
Users remain fully responsible for their own interpretations and decisions.

4. Membership Fees & Service Access

BetterLytix may offer monthly, annual, or lifetime digital access packages.
All purchases are processed in USD. Any displayed conversions are for convenience only.

Upon purchase, Users receive instant access to digital content.
Because the service is delivered immediately, no refunds or withdrawal rights apply (see Section 10).

BetterLytix may charge a periodic maintenance/back-office fee for continued technical access.

5. Delivery of Services

Services may be delivered through:

• the BetterLytix dashboard,
• official communication channels, including but not limited to Telegram,
• online learning environments for educational content.

Data content may include structured information, summaries, or analytical breakdowns, strictly for informational use.

6. User Eligibility

Users must:

• be at least 18 years old,
• comply with local laws applicable to digital content, analytics, or online education,
• not reside in jurisdictions restricted by international sanctions (OFAC, EU, UN).

BetterLytix may deny service where restricted by law.

7. Accounts & Access Control

Users must ensure that login information and access credentials remain confidential.
Sharing, reselling, or redistributing BetterLytix content or access will result in immediate termination without refund.

BetterLytix may implement technical measures to prevent unauthorized access.

8. Affiliate Program

The BetterLytix Affiliate Program allows Users to earn commissions for valid referrals.
Participation requires acceptance of the separate Affiliate Agreement, which governs:

• commission structures,
• payout requirements,
• responsibilities and limitations.

These Terms do not override the Affiliate Agreement.

9. Intellectual Property

All content, data, analytics, videos, branding, and materials are the exclusive property of BetterLytix Tech LLC.

Users receive a personal, non-transferable, non-commercial license to access the content.

Copying, distributing, reverse-engineering, or sublicensing BetterLytix content is strictly prohibited.

10. Refunds & Withdrawal Rights

By purchasing, you acknowledge that:

• digital services are delivered immediately,
• therefore, no withdrawal, cancellation, or refund rights apply.

This waiver complies with international digital goods regulations and consumer laws where applicable.

11. Disclaimer of Responsibility

Users agree that:

• BetterLytix does not guarantee accuracy, completeness, or usefulness of data,
• BetterLytix is not responsible for user decisions, interpretations, or actions,
• all content is informational only.

BetterLytix is not liable for any financial, reputational, or emotional losses resulting from user behavior or choices.

12. Limitation of Liability & No Lawsuit Policy

To the maximum extent permitted by applicable law, the User agrees and acknowledges that:

1. BetterLytix Tech LLC provides digital informational content only, delivered instantly upon purchase.
   Therefore, all sales are final and non-refundable, under all circumstances, without exception.
2. BetterLytix Tech LLC shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages of any kind, including but not limited to:
   • financial losses,
   • perceived losses,
   • opportunity losses,
   • business interruption,
   • reputational impact,
   • decisions made by the User based on provided data.
3. The User explicitly agrees that no claim, lawsuit, demand, chargeback, complaint, arbitration, or legal action of any kind may be filed against BetterLytix Tech LLC relating to:
   • the content provided,
   • data interpretation,
   • platform access,
   • analytics accuracy,
   • affiliate program participation,
   • any action or decision the User takes.
4. The User understands and accepts that the use of BetterLytix services is entirely at their own risk, and BetterLytix Tech LLC assumes no responsibility for any outcome resulting from the use of its digital content.
5. In jurisdictions where a complete liability exclusion is not legally possible, the User agrees that the maximum liability of BetterLytix Tech LLC is USD 0 (zero).
6. By accessing or using the services, the User waives any right to participate in a collective lawsuit, class action, group litigation, arbitration, or dispute process against BetterLytix Tech LLC.

13. Indemnification

Users agree to indemnify BetterLytix Tech LLC, including its officers and partners, against claims arising from:

• misuse of the Platform,
• breach of these Terms,
• violation of applicable law.

14. Data Protection & Privacy

BetterLytix operates under the laws of Nevis and voluntarily aligns with GDPR Article 3(2) for EU users.

We collect only essential information and do not sell or share personal data except as required by:

• legal obligations,
• payment processors,
• platform infrastructure providers.

15. Modifications to Terms

BetterLytix Tech LLC may modify these Terms at any time.
Updated Terms become effective upon posting.
Continued use of the Platform means acceptance of all modifications.

16. Termination

BetterLytix may suspend or terminate User access if the User:

• violates these Terms,
• distributes or leaks proprietary content,
• engages in fraudulent or prohibited activities.

Terminated Users are not entitled to refunds.

17. Force Majeure

BetterLytix shall not be responsible for delays or failures caused by events beyond reasonable control, including but not limited to technical outages, cyberattacks, regulatory changes, or natural events.

18. Governing Law & Jurisdiction

These Terms shall be governed exclusively by the laws of Nevis.
Any dispute shall be resolved in the competent courts of Nevis unless mandatory laws require otherwise.

20. Severability Clause

If any provision is found invalid, that provision will be adjusted or removed while all remaining terms continue in full force.

By accessing or using any BetterLytix Tech LLC service, you confirm that you:

3. agree that each of these documents complements and reinforces the others as part of a unified legal framework,
4. acknowledge that all current and future BetterLytix legal documents are binding upon publication,
5. accept that updates or additions to any legal document apply automatically to your continued use of the platform,
6. agree that hyperlinks to such documents constitute valid and enforceable legal notice,
7. understand that using the platform requires full acceptance of ALL current and future linked policies without exception,
8. accept that any breach of any individual document may result in suspension, restriction, or termination of access,
9. agree that the governing law for all documents is St. Kitts & Nevis,
10. confirm that BetterLytix Tech LLC may modify, expand, or update these legal documents at any time,
11. agree that continued use after any modification constitutes automatic acceptance,
12. acknowledge that all cross-linked documents form the complete, binding legal agreement between you and BetterLytix Tech LLC.
